Agreement between User & Champaign Counseling
Welcome to Champaign Counseling. The Champaign Counseling website (the “Site”) is comprised of various web pages operated by Champaign Counseling.
This site is offered to you conditioned on your acceptance without modification of the terms, conditions, and notices contained herein (the “Terms”). Your use of our site constitutes your agreement to all such Terms. Please read these terms carefully, and keep a copy of them for your reference.
We provide psychoeducational information, as well as information regarding the mental health services we offer.
Privacy
Your use of the Champaign Counseling site is subject to our Privacy Policy. Please review our Privacy Policy, which also governs the Site and informs users of our data collection practices.
Electronic Communications
Visiting our site or sending emails to Champaign Counseling constitutes electronic communications. You consent to receive electronic communications and you agree that all agreements, notices, disclosures and other communications that we provide to you electronically, via email and on the Site, satisfy any legal requirement that such communications be in writing.
Psychotherapy Services
We provide psychotherapy services for children, adolescents, adults, couples, and families. The first appointment(s) serves as an intake appointment. We will want to hear about the difficulties that led to you making an appointment, goals for therapy, and general information about yourself and your current life situation. By the end of this first appointment, we will give you some initial recommendations on what we think will help. If we do not think we are able to best assist you, we will give you names of other professionals who we believe would work well with your issues. If you do not agree with our treatment recommendations or do not think our personality styles will be a good match for you, let us know and we will do our best to suggest a different therapist who may be a better fit. The first two appointments will also include a diagnostic assessment, which is required in order to bill insurance.
If you and your therapist decide to work together in therapy, you will collaborate on a treatment plan that incorporates effective strategies to help with whatever difficulties you are hoping to reduce in therapy. Sometimes more than one approach is helpful. Individual, couples, and family therapy sessions last 45-60 minutes (depending on your insurance benefits and clinical presentation) unless otherwise arranged. Oftentimes, sessions are set for once each week, but this varies based on what seems most appropriate for your situation.
There are benefits and risks to therapy. Potential benefits include increased healthy habits, improved communication, and stability in relationships, and lessening of distress. Some potential risks include increased uncomfortable emotions as you self-explore, and changes in dynamics or communication with significant people in your life. Although there are many benefits to therapy, there is no guarantee of positive or intended results.
Cancelling a Session
Please respect our time, your time, and other clients’ time by rescheduling at least 24 hours in advance if you cannot make an appointment. We understand that emergencies arise, so we allow one emergency cancellation per year beginning on the date of your first session. Otherwise, if an appointment is missed or canceled with less than 24-hour notice, you will be charged a cancellation fee of $110 for that missed session. This fee will not be covered by insurance. For example, if you start therapy on January 1, 2022, and late cancel on June 6, 2022, then you will be charged for any additional late cancel you have before January 1, 2023. On January 1, 2023, you will have another 1 “freebie” late cancellation for the next 12 months.
Please note that you are responsible for providing 24 hours notice of cancellation, regardless of whether or not you received an appointment reminder.
If you have any symptoms of illness that begin less than 24 hours before your appointment, please call our office as soon as possible, as you may be able to have your session via teletherapy.
If you attend a session and are under the influence of alcohol or drugs, or in possession of a dangerous weapon, your session will be canceled, and you will be charged the late cancellation fee of $110.
Minors
If you are under 12 years of age, the law provides your parents or legal guardians the right to examine your treatment records. If you are between the ages of 12 and 17, the law may provide your parents the right to examine your treatment records. This is only true if after being informed of your parents’ request to examine your records, you do not object, and your therapist does not find that there are compelling reasons for denying access to your records. Your parents or legal guardians are always entitled to the following information: current physical and mental condition, diagnosis, treatment needs, services provided, and services needed, including medication, if any. Before providing any information, if at all possible, your therapist will discuss the matter with you, and work with you to handle any objections you may have about what information is being requested.
If there is a custody agreement for a minor client and it is not provided prior to the start of the second session, the appointment will be canceled, and you will be charged the cancellation fee.
We ask that parents/guardians of children 12 and under remain on the premises during their child’s appointment. No child under the age of 12 is to be left alone without an accompanying adult in our waiting room or lobby area. If your child is in the waiting room and unable to behave appropriately, an adult must remain on the premises.
Therapist-Patient Privilege: The information disclosed by you to your therapist, as well as any records created, is subject to the therapist-patient privilege. The therapist-patient privilege results from the special relationship between Therapist and Patient in the eyes of the law. Therapist-patient privilege is akin to attorney-client privilege or doctor-patient privilege.
Typically, the patient is the holder of the therapist-patient privilege. If we receive a subpoena for records, deposition testimony, or testimony in a court of law, we may assert the therapist-patient privilege on your behalf until instructed to do otherwise by you or your representative, or if a court order by a judge is provided. This request must be in writing. If you make your mental or emotional state an issue in a legal proceeding, you could be waiving the therapist-patient privilege regarding your entire treatment. Please address any concerns you might have regarding the therapist-patient privilege with your attorney.
Links to Third Party Sites or Third Party Services
Our site may contain links to other websites (“Linked Sites”). The Linked Sites are not under the control of Champaign Counseling and Champaign Counseling is not responsible for the contents of any Linked Site, including without limitation any link contained in a Linked Site, or any changes or updates to a Linked Site. Champaign Counseling is providing these links to you only as a convenience, and the inclusion of any link does not imply endorsement by Champaign Counseling of the site or any association with its operators.
Certain services made available via our site are delivered by third party sites and organizations. By using any product, service or functionality originating from the Champaign Counseling domain, you hereby acknowledge and consent that Champaign Counseling may share such information and data with any third party with whom Champaign Counseling has a contractual relationship to provide the requested product, service or functionality on behalf of our site’s users and customers.
No Unlawful or Prohibited Use of Intellectual Property
You are granted a non-exclusive, non-transferable, revocable license to access and use our site strictly in accordance with these terms of use. As a condition of your use of the Site, you warrant to Champaign Counseling that you will not use the Site for any purpose that is unlawful or prohibited by these Terms. You may not use the Site in any manner which could damage, disable, overburden, or impair the Site or interfere with any other party’s use and enjoyment of the Site. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available or provided for through the Site.
All content included as part of the Service, such as text, graphics, logos, images, as well as the compilation thereof, and any software used on the Site, is the property of Champaign Counseling or its suppliers and protected by copyright and other laws that protect intellectual property and proprietary rights. You agree to observe and abide by all copyright and other proprietary notices, legends or other restrictions contained in any such content and will not make any changes thereto.
You will not modify, publish, transmit, reverse engineer, participate in the transfer or sale, create derivative works, or in any way exploit any of the content, in whole or in part, found on the Site. Champaign Counseling content is not for resale. Your use of the Site does not entitle you to make any unauthorized use of any protected content, and in particular you will not delete or alter any proprietary rights or attribution notices in any content. You will use protected content solely for your personal use, and will make no other use of the content without the express written permission of Champaign Counseling and the copyright owner. You agree that you do not acquire any ownership rights in any protected content. We do not grant you any licenses, express or implied, to the intellectual property of Champaign Counseling or our licensors except as expressly authorized by these Terms.
International Users
The Service is controlled, operated and administered by Champaign Counseling from our offices within the USA. If you access the Service from a location outside the USA, you are responsible for compliance with all local laws. You agree that you will not use the Champaign Counseling Content accessed through our site in any country or in any manner prohibited by any applicable laws, restrictions or regulations.
Indemnification
You agree to indemnify, defend and hold harmless Champaign Counseling, its officers, directors, employees, agents and third parties, for any losses, costs, liabilities and expenses (including reasonable attorney’s fees) relating to or arising out of your use of or inability to use the Site or services, any user postings made by you, your violation of any terms of this Agreement or your violation of any rights of a third party, or your violation of any applicable laws, rules or regulations. Champaign Counseling reserves the right, at its own cost, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will fully cooperate with Champaign Counseling in asserting any available defenses
Liability Disclaimer
THE INFORMATION, SOFTWARE, PRODUCTS, AND SERVICES INCLUDED IN OR AVAILABLE THROUGH THE SITE MAY INCLUDE INACCURACIES OR TYPOGRAPHICAL ERRORS. CHANGES ARE PERIODICALLY ADDED TO THE INFORMATION HEREIN. Champaign Counseling AND/OR ITS SUPPLIERS MAY MAKE IMPROVEMENTS AND/OR CHANGES IN THE SITE AT ANY TIME.
Champaign Counseling AND/OR ITS SUPPLIERS MAKE NO REPRESENTATIONS ABOUT THE SUITABILITY, RELIABILITY, AVAILABILITY, TIMELINESS, AND ACCURACY OF THE INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS CONTAINED ON THE SITE FOR ANY PURPOSE. IF YOU ARE DISSATISFIED WITH ANY PORTION OF THE SITE, OR WITH ANY OF THESE TERMS OF USE, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USING THE SITE.
Termination/Access Restriction
Champaign Counseling reserves the right, in its sole discretion, to terminate your access to the Site and the related services or any portion thereof at any time, without notice. To the maximum extent permitted by law, this agreement is governed by the laws of the State of Illinois and you hereby consent to the exclusive jurisdiction and venue of courts in Illinois in all disputes arising out of or relating to the use of the Site. Use of the Site is unauthorized in any jurisdiction that does not give effect to all provisions of these Terms, including, without limitation, this section.
You agree that no joint venture, partnership, employment, or agency relationship exists between you and Champaign Counseling as a result of this agreement or use of the Site. Champaign Counseling’s performance of this agreement is subject to existing laws and legal process, and nothing contained in this agreement is in derogation of Champaign Counseling’s right to comply with governmental, court and law enforcement requests or requirements relating to your use of the Site or information provided to or gathered by Champaign Counseling with respect to such use. If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect.
Unless otherwise specified herein, this agreement constitutes the entire agreement between the user and Champaign Counseling with respect to the Site and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between the user and Champaign Counseling with respect to the Site. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. It is the express wish to the parties that this agreement and all related documents be written in English.
Changes to Terms
Champaign Counseling reserves the right, in its sole discretion, to change the Terms under which our site is offered. The most current version of the Terms will supersede all previous versions. Champaign Counseling encourages you to periodically review the Terms to stay informed of our updates.
